The Legal Services Department provides legal advice and representation to both Humberside Police & South Yorkshire Police, as Legal Officer/Senior Legal Officer you will be responsible for:
- Under supervision conduct a caseload of civil claims on behalf of the Chief Constable, undertaking research, liaising with interested parties, interviewing witnesses at all levels, assessing information, making decisions on liability and compiling reports for solicitors. This includes making recommendations for settlement or undertaking negotiations and putting forward arguments to reach a settlement with the claimant.
- Deal with disclosure requests from individuals, Solicitors, Local Authority and Courts including assessing requests, conducting research, liaising and negotiating with internal and external parties and making decisions on appropriate disclosure. Making necessary applications to court, arranging representation and attending court to provide assistance.
- Manage the process of gaining disclosure, from court relating to criminal investigations and balance needs of competing disclosure demands.
- Deal with police property act applications, dangerous dog and firearms files undertaking research, preparing evidence bundles and serving proceedings on individuals/organisations, working with the Senior Legal Officer.
- Under supervision provide legal advice on a broad range of topics by researching and interpreting legislation, policy and national guidance to officers at all levels.
- Attend proceedings to support Counsel and provide updates to Head of Department by producing a comprehensive summary to include the salient points.
- Conduct any other research requested by the Senior Legal Officer / Principal Lawyer.
- Organise and prioritise own workload and manage deadlines.
- Following consultation with Senior Legal Officer liaise with external partners in relation to disclosure and write undertakings for information sharing.
- Performs such other duties as reasonably correspond to the general character of the post and are commensurate with its level of responsibility.
Should the role applied for be Senior Legal Officer the duties will include the above but varied to include
- Supervision of Legal Officer
- Independently conducting a caseload
- Manage and direct, legal disclosure requests from individuals/solicitors.
- Independently provide legal advice
- Conduct any other research on behalf of the Head of Legal Services
- Write undertakings for information sharing. In more complex cases liaise with external partners. Advise Legal officers in relation to disclosure and writing undertakings
Skills and experience:
- Educated to ‘A’ Level standard with a legal qualification e.g. law degree or CILEX Professional Qualification – Foundation stage
- Detailed knowledge and advocacy (if senior role) skills of law and practice in at least one of the following areas: civil law.
- Detailed Knowledge and experience of litigation and an understanding of ECHR, Civil Procedure Rules.
- Experience of drafting witness statements and creating files for Court, experience of claims handling, negotiating settlements and producing reports.
- Ability to manage a diverse caseload which is high risk and complex, providing clear and legally sound advice.
- Excellent oral and written communication skills to deal with all ranks of officer, support staff and external agencies.
- Ability to use professional judgement to make accurate decisions relating to legal matters. Ability to assimilate large amounts of information and make appropriate evaluations in order to recommend a course of action.
- Manage the allocation of legal caseloads and staffing resource if Senior role
- In accordance with financial and insurance regulations seek approval on cases
- If senior role - Demonstrable experience of the management and conduct of civil claims for malfeasance and Personal Injury and other civil proceedings concerning the Chief Constable.
